The story is out that Dotcom’s evidence for tonight is an email. The NZ Herald reports:

– Purported email is the evidence Kim Dotcom plans to reveal tonight

– Said to be written by Warner Bros CEO at time of Hobbit negotiations

– PM allegedly in on plan to have Dotcom extradited to US

– Key and Warner Bros yet to respond to claims

It is the evidence which Dotcom is planning on producing at the Moment of Truth event tonight.

It is also contrary to every assurance the Prime Minister has ever given about his knowledge of Dotcom.

The source of the email is shrouded in mystery and there are likely to be arguments over its authenticity.

Calls from the Herald to Warner Bros, the MPAA and the Prime Minister have yet to bring a response.

I look forward to the latest shift by John Key in the story he’s telling. here is the content of the email referred to in the above article:

The claimed email reads: “We had a really good meeting with the Prime Minister. He’s a fan and we’re getting what we came for. Your groundwork in New Zealand is paying off. I see strong support for our anti-piracy effort.

“John Key told me in private that they are granting Dotcom residency despite pushback from officials about his criminal past. His AG will do everything in his power to assist us with our case. VIP treatment and then a one-way ticket to Virginia.

“This is a game changer. The DOJ is against the Hong Kong option. No confidence in the Chinese. Great job.”

It is dated the day before the decision to grant Dotcom residency on October 28.

And here is an article by Gordon Campbell, written in July 2014, about a related email trail discussed in the Dotcom court case.  He supports the argument that Dotcom was granted residency in NZ in order to deliver him up for extradiction to the US.

The NZ Herald has now updated the above article, with a counter claim that the email is fake:

However, Warner Bros told the Herald the email was a fake. Paul McGuire, the movie studio’s senior vice president for worldwide communications, told the Herald: “Kevin Tsujihara did not write or send the alleged email, and he never had any such conversation with Prime Minister Key.”

lprent: Cameron Slater is purporting to know what he is talking about with this email. All he has managed to prove is that he is technically an idiot.

In one part of his “proof” he is saying that this image of the email

Does not conform with what an email text looks. The problem is that compares it with the internal format of an email header, a format known as RFC822 and its various subsequent modifications. That stipulates that the timezone and or offset from universal time is specified.

The problem for the poor deluded fool is that the image is of a email displayed in an email reader. They don’t have to display it that way. They usually display in local time.

In this case that (from an offhand look and from memory)  looks exactly like the command line email reader in unix.

I’d point out that I have been programming RFC822 readers since 1990.

        He’s back in Court today (well he isn’t but his legal team are) and showing that there is a conspiracy surrounding him is part of the strategy I understand he is running. This could explain why the announcement was scheduled for today and why his lawyer from the states is in Auckland. He is seeking a Judicial Review of the decision not to make the FBI hand everything over (copies thereof) that they took

              Dotcom has also promised an affidavit to go with his “Moment of Truth” bombshell:

              Kim Dotcom has told ONE News he will produce an affidavit tomorrow, as part of his “moment of truth”, proving there was political pressure to grant his residency in 2010.

    There is another really unfortunate piece of information, the suggestion on the SIS file from 5 days before this email that political pressure had been applied to the SIS to let Dotcom stay.

    I posted earlier (http://thestandard.org.nz/dotcom-who-applied-the-political-pressure/) about the pressure on the SIS.

    In particular I said this:

    That day [October 22, 2010] the Hobbit dispute was raging out of control. There are dating back to that time a series of perceptive posts by IrishBill which gave a real sense of the games that were being played by National and by Warner Brothers. This post written the day before and the 516 comments attached to it clearly captured the intensity of what was happening. So on the Friday when the dispute was raging hardest political pressure was applied to let Dotcom stay in New Zealand against advice. Hooton claims that the conspiracy theory that Dotcom’s scalp was negotiated between Warner Brothers and the Government could be “a bit fanciful”. But give me a tin foil hat and call me a conspiracy theorist there has to be a better explanation than Coleman’s “nothing to see here”.

    So the SIS referred to political pressure being applied and five days later the Chief Executive of Warner Bros confirms that John Key himself was in on the decision.

    Of course this is nothing to be worried about, just an unfortunate series of coincidences and everyone but the Prime Minister is wrong …

        here is early reporting of Key’s denial

        ” Key has repeatedly denied discussing Dotcom’s case with movie studio executives or anyone else and insists the first he heard about Dotcom was at a briefing the day before the raid.

        Key responded today saying: “I do not believe that to be correct, I have no recollection of the conversation that’s alluded to in that email.

        “There are no records there and the meetings that I had were with other people around me, so in the end, we’re going to get to the bottom of it but we don’t have any record of it.

        “In all the meetings that I had with Mr Tsujihara were in public, with other people being there.

        Asked if the other executives would back him up, Key replied: “In the end, you’ll have to talk to Kevin [Tsujihara], but the meetings that I had with him were with lots of other people around me.”

        Key said he was only made aware of the email 10 minutes before speaking with media, but he would be checking with the relevant Hollywood executives the authenticity of the email.

        “But look, I’d never heard of the guy [Dotcom] I’d never been briefed on the guy, so i can’t recall any conversation with him, I don’t believe it to be correct – we’ll go and check that out.”

        Key said he believed the email was sent by one of the executives to the MPAA.

        Key flatly rejected being involved in any plan to extradite Dotcom to the US. “

        Actually, I really would love to know what extent of spying there was on this Warner Bros/Hobbit meeting.

        In theory they should have been keeping a close eye on it as it potentially (& from the outside appears to have actually) involved collusion of senior elected officials with external interests against the interests of NZ.

        I agree Karol but this Dotcom sideshow is causing all the good policies released by the Green party and others to be lost in a heap of scuttlebutt while the media run around like headless chooks hanging on Dotcom’s every utterance.

        I think the likely outcome of this latest circus will be to put even more people off voting which is a shame if the media spent more of its time presenting the different parties policy rather than making the election all about Dotcom and themselves perhaps more people would be inclined to vote.

          The Hobbit law, collusions with Warners, the MPAA, NSA, etc, have all been ongoing issues in the term of this government.

          They include significant policy areas like employment law, workers’ rights, the TPPA, copyright laws, the role and practices of the GCSB, practices involved in promoting NZ’s screen industry, etc,etc.

    Evidently there is going to be an affidavit produced tonight that will, I assume, support the authenticity of the email contents if not the email itself.

    Don’t know what it all means as far as the election goes. I do wish this had come out earlier, and this election had been about policies, but then I suspect the MSM would never have talked about policy anyway.

    This is just one email, DotCom has said he has documents (plural).

    An affidavit I assume can ONLY prove the authenticity of that email if an annexure to the email is from someone who checked its authenticity. In that case an affidavit from the person doing the authenticating is the best evidence.

    I doubt very much the email is a fake, Kim Dotcom could not afford to use fake emails, it would not be in his interests to risk doing something like that. Of course Warner Bros will be claiming its fake, because they don’t want to be seen interfering with politics of another country.

    Key’s been trying to pre-burn speculation about mass surveillance plans, the msm have been speculating about whether we spy on trading partners or even allies, and now this email…

    I’m starting to wonder if Key has been suckered by the Herald’s story. He has replied by again denying knowing he knew of the plan to grant Dotcom residency in order that KDC be swiftly extradited. He should have said nothing. If anything, ‘so, I hear Warners say it’s a fake and and at the end of the day …’ By putting aside the authenticity of the email as a defence he has focussed instead on his alleged Big Lie. That’s an all or nothing stance, an unusual tactic for a serial fibber and fudger.

    If Dotcom has deliberately leaked the email as a ‘teaser’ to get Key to repeat the supposed porkie, or even to just talk about the extradition plot at all, then Key has set himself up and it would be a simple coup de grace for KDC to provide evidence of the collusion tonight. Key de Grace?

    Key’s gone if there is any corroboration.

    But even if KDC can’t follow through tonight, then Key’s credibility is still the issue four days out from an election. That’s not at blueprint for an election winning strategy. Good times!

      Is it worth remembering here that Kim Dotcom was only 15 years old when he hacked into NASA to see if aliens really existed; and then hacked into and changed the German Chancellor’s personal credit rating at a major bank because he simply didn’t like him.

      These are his major crimes, and when he was convicted, the German govt chose instead to give KDC $1,000,000 to start his own security company. .. and do the government’s as well, but this last fact I am not so sure about.

      I’m backing him, his skills and intellect against all of them .. Key, NSA, Hollywood, GCSB et al. Bring it on tonight !! Kia Kaha.

    If this e-mail was genuine, then why hasn’t Dotcom used it in his extradition proceedings, as it would surely be highly beneficial to his case.

    Anyway, Slater has done some good technical analysis of the e-mail I know Slater isn’t the most popular entity on this site, however, an objective reading of his logic on this one makes it fairly obvious that the “e-mail” is a fake.

    I’ve been working with the RFC822 and its various enhancements since about 1990. It is damn obvious that Slater is just repeating someones mischief and he is too stupid to understand the email format. ]

      I think KDC has been planning to use such an email in his case. But the case hasn’t got that far yet. His lawyers are currently asking for more of the documents the prosecution/FBI/GCSB won’t release.

      Apparently its not the done thing to use Courier ( non proportional) font.

      Then someone found a url about formatting at Warners in , you guessed it, Courier !

    MANA Movement Leader and Te Tai Tokerau MP Hone Harawira has today lodged a Privileges Complaint with the Speaker regarding the Prime Ministers denials in parliament that he knew anything about Kim Dotcom before 2012.
    “Information made public today appears to contradict John Key’s statements and I have therefore asked the Speaker to refer it to the Privileges Committee for investigation.”

      Although, since then, he’s uncritically reported that Laila Harre says it is authentic.

      It is a puzzle though. Because Fisher does say tat he received the email from someone other than KDC yesterday afternoon, confirmed with KDC that it was the evidence he would produce that evening. But then it seems lawyers decided to send the email to the privileges committee.

      I’m not convinced about the email’s authenticity, nor am I sure it’s a fake. It’s a bit strange.

    I just wish to comment on Mr Key’s language, including body language, where he was refuting the genuineness of that email on the News clips last night.

    Key was using a strong style of ‘legally protected’ language. All of his statements contained phrases like ‘I don’t recall’, ‘as far as I remember’, ‘I don’t believe’. This is unconvincing language. It is deceptive language, for example, ‘We have no record of it’ is not the same thing as ‘it doesn’t exist’. ‘We have no record of it’ could simply mean ‘we deleted all trace of it’, yet the wording is designed to leave listeners with quite a different impression.

    Key’s body language is also unconvincing. Note the blinking and pursing of lips. I have to say, he has been uncharacteristically poor at feigning sincerity on this one.

    1. The font is Lucida Console. This is the default font used by Windows Notepad.

    2. In Microsoft Outlook you can do a bulk export of all emails in a folder. This produces a (possibly quite large) text file containing all the messages.

    3. Bulk Export would be the most efficient way of storing and parsing a large amount of data, because it strips out html / rtf (formatting info) / images / headers, and just keeps the content.

    4. Without the RFC822 message ID and routing information we can’t *prove* the email is genuine. Equally, we can’t dismiss out of hand either.

    5. WB and JK have every reason to cover up their collusion against KDC. There is some pretty compelling circumstantial evidence.

      * searched and found an email that WB and JK would prefer not to exist

      * pasted the file (or a portion thereof) to windows notepad

      * leaked the text file or screengrab to KDC.

    As pointed out by David Farrar, this must be the only e-mail in American history where the date structure is “Day/Month/Year”. (The usual set up for UK, Oz and NZ etc). The american system is “Month/Day/Year” i.e. 9/11 does not mean the 9th of November, it means September 11th. It seems the “author” of the e-mail forgot this when making it up !!
