Journalists fighting oil palm plantation found stabbed to death in Sumatra 6 November 2019

    https://asiapacificreport.nz/2019/11/06/journalists-fighting-oil-palm-plantation-found-dead-in-sumatra/

Witnesses said the journalists had also been involved with a community dispute with the plantation company in which the community was attempting to take control of the oil palm once the local forestry office had ruled that the company’s expansion onto forested land was illegal.

(I suggest that anything containing palm oil, palmate be avoided even if it is said to be plantation grown. Question, whose land is the plantation on, and what used to grow there before palm oil trees?)

I hope the outcome of the Grace Milane case doesn't mean women will now have to make it clear they do not consent to be strangled, so it can't be used as a defence later on.

    • Sabine 3.1

nope, the outcome of the Grace Milane case simply shows that women are responsible for being murdered. The murderer is not responsible because the women may and may not have consented to a little rough sex gone awry even tho no one cared to ask the dead women if she indeed consented to a little rough sex.

This was posted today on the Open Thread and it shows that 'she consented to being strangled, beaten, broken, , hog tied, etc ' is indeed a defense for murder.

      see here https://wecantconsenttothis.uk/

this one i just can't wrap my mind around. Just no words.

      https://www.independent.co.uk/voices/natalie-connolly-john-broadhurst-case-trial-murder-rough-sex-domestic-violence-manslaughter-a8690961.html

John Broadhurst killed Natalie, his girlfriend, at his home two years ago this week, when her then eight-year-old daughter would have been looking forward to Christmas. Natalie sustained no fewer than 40 separate injuries, including serious internal trauma (, a fractured eye socket and facial wounds. He poured bleach on her face. Bleeding but still alive, the woman who Broadhurt’s defence team claimed was his “loved one” was left to die at the bottom of this stairs while he went to sleep, and when he eventually called 999 he described Natalie – supposedly his “loved one”, remember – “as dead as a doughnut”.

Broadhurst, a millionaire property developer, claimed she died during “rough sex”. In his trial for murder, the prosecution said that “whatever may have started willingly there is no way that Natalie either consented to or was able to consent to what John Broadhurst did to her after that”. Jurors were told that Broadhurst had “lost it” after finding topless pictures she had sent to another man on social media and wanted to “teach her a lesson”. …………………

……….As Harriet Harman, the former solicitor general who is raising this case with the attorney general as an unduly lenient sentence says, a dangerous legal precedent is at risk of being set, and that “any man charged with killing a current or former partner or prostitute could simply say she wanted it”.

    • weka 3.2

In the UK it's already often used as a defence. NZ apparently has different laws that mean it's less common here.

Numerous studies have shown that non-fatal strangulation is one of the highest markers for future homicide, which is why Australia, New Zealand, Canada and most US states have developed preventative legislation to strengthen police, prosecutorial and sentencing policies that surround it. In most US states, for example, it is now compulsory for police to charge strangulation assaults as felonies. Yet in the UK, they can fall under battery – the mildest assault possible.

      https://www.theguardian.com/society/2019/jul/25/fatal-hateful-rise-of-choking-during-sex

Personally I'd be good with a public health campaign that says if you want to strangle someone during sex and they die expect a lengthy jail sentence.

      • Sacha 3.2.1

If you stuff someone in a suitcase then bury them somewhere a couple of days later rather than call the police right away I do not much care how you killed them. What a disgusting person.

        • weka 3.2.1.1

Yep. Then went out on a date afterwards. I'm not a fan of imprisoning people, for a range of reasons, but it's hard to know what else can be done with such a person other than locking them away from free society.

          • James Thrace 3.2.1.1.1

I saw suggested somewhere that if anyone wants to use the "accidental strangulation" defence that it should only be given due weight if emergency services were called immediately upon realisation of death.

This dickbags actions afterward show it was not accidental.

And in any event it's pretty clear when someone is choking to death.

            • Incognito 3.2.1.1.1.1

Weird irrational behaviour after you have killed somebody is evidence of the killing being intentional and pre-meditated? You’d make a good Crown prosecutor; they can apparently read you like a book by your mannerisms and body language but they never judge a book by its cover.

              • James Thrace

That's not what I said at all, but good on you for twisting my words.

                • Incognito

This dickbags actions afterward show it was not accidental. [my italics]

These were your words. How/what did I twist?

                  • weka

It's not an unfair thing to suggest. Driving off some a hit and run scene is kind of understandable. Strangling someone, hiding their body, then going out on another date, lying to the police, that's not someone panicking from a mistake.

I would expect the various people in the justice system to be more evenhanded in its approach, but it's pretty clear that there is an emerging social dynamic happening that is gendered, in the context of an already appalling legal system when it comes to justice for women who have been assaulted. I think society needs to shift and take women's safety more seriously, and includes in how we manage crimes like this.

              • Sacha

Oh I'd expect irrational behaviour – not taking photos, internet searching disposal options, shopping for cleaning supplies, hiring a car, going on another 'date'..

                • Incognito

It is not a binary. My point to James Thrace was how the accused's behaviour afterwards shows the death was not accidental. I don’t think it shows that and it is a speculative assumption IMO on how the accused should to have acted after he had killed somebody. Unless, of course, James is a psychologist experienced in these kinds of cases but so far, he’s offered nothing of substance, not even a link, just hearsay.

          • greywarshark 3.2.1.1.2

A partial lobotomy might become the preferred option for sexual predators mainly male, who are too bent for habilitation, though it should be earnestly tried before they continue rape or go onto murder, or manslaughter. It would be cheaper than life-time incarceration in controlled surroundings.

But governments and power elites having a higher respect for parents and children would cut across the formation of bad thinking and violent behaviour. Government modelling good ethical, concerned behaviour to people would mean they would repeat it in their home and community life.

This would cut down the number of damaged children that become perverts as adults. Also the filmed and TV material would be censored on not showing scenes of cruelty and rape and other actions or words that indicate that there is some buzz to be had from such behaviour that is okay when carried out by those who think they are entitled.

Changes like this would go to prevent what could be an eventual situation of females not being able to trust males at all, and living in female-run enclaves like convents. But aren't we able to think of better ways of behaving. We have intricate management keeping the ephemeral financial system going. We have rules for sharing the roads enabling us to move around easily. We could also think of ways of having better sexual relationships. This strangulation thing is strange, and screwy. The reasonable attitude should be that, if you are bored with ordinary sex then you have over-indulged, and a time of fasting would bring about renewed appreciation. That would be a reasoned antidote which would lessen what are actual assaults. If prostitutes are catering for this behaviour that is unwise. Prostitution was made legal so they would be safer in their often precarious work. If changes to our sexual attitudes and practices are beyond our mental and organisational powers I think we will see Brave New World ideas where it was discouraged with some medication.

It would be good if it could be spelt out by having discussions with teenagers, because some can start activity around 14 years. Females are vulnerable in sexual encounters; males can be also. Care for and look after yourself – to start with, don't send naked pictures of yourself on-line, or by photos, or drawings etc. The person receiving is unlikely to be worthy of your gift. If everyone is doing it, so what, just decide your own ways. Don't be drawn into a relationship with anyone you don't know well whether they look reasonable or not. Be aware that there are uncaring. even evil people out there who would hurt you without concern. Don't be such a loose person yourself; respect yourself and others. Don't just look at someone's appearance, have a look at their mind and what they say, look for the con artist, or the person with the crude attitude who speaks the language of the Urban Dictionary! Sex is giving part of yourself to match with someone else's giving, it is better to choose carefully from the menu to avoid a disappointing encounter that isn't special to both. Be aware that it could turn bad, and could be disastrous.

Climate Change investment by the NZ Government, an exercise in pointlessness. $26 million to the American NGO the Environmental Defense Fund, in order to help fund a " a state-of-art, methane-tracking satellite. "

A further $10 million will be invested in establishing a NZ government funded and run command centre. Apparently an exciting event for the 2016 New Zealand Space Agency, not so relevant for the majority of NZers though.

The Environmental Defense Fund is a misnomer. It is an agency that continues to facilitate the use of fossil fuels, as was outlined in This Changes Everything, by Naomi Klein. A site search of "sustainable shale" on the EDF website, shows their attitude towards climate change, BAU for as long as possible. They were instrumental in working with the oil and gas industry to create the The Center for Sustainable Shale Development (CSSD).

This approach to climate change transition is failing, and once again, we are still investing common resources and trust in vested interests.

    • marty mars 6.1

What a joke. Shows the utter rubbish this government is saying they are doing about the climate emergency. Criminal negligence imo

Have a look at this wee beastie forming the Western Pacific and it’s still a cat 2 Typhoon/ Cyclone atm.

    https://www.stuff.co.nz/world/117222999/super-typhoon-halong-is-among-the-strongest-storms-ever-observed-by-satellite

I hope the wife and I don’t encounter likes of this wee beastie when the Northern Australian Cyclone/ Monsoon Season officially starts on the 1st of Dec, but the current 3mth forecast as of last Sunday was saying a late start to the monsoon season as the Indian monsoon was late this yr and because of this we may a 65% reduction in Cyclones in Northern Australian. This reduction in cyclones is going to hit those Mexicans Sth of the tropics real hard as there will be bugger all water flowing in the Murray- Darling river basin

    Welcome to CC folks.

    • greywarshark 7.1

We don't need to worry – we will have a share in an exciting satellite tracking methane and where it comes from. As if we don't know.

And another example of how a machine is put in between the society and it's needed actions . Why go straight to the problem, and when it is grasped then start immediately pilot schemes which will test the best method to deal with it. No go to a high point and look down on it all objectively, measure it, have meetings about it, have specialised research to identify that it comes from a small x meeting a small y when the right ionisation is reached???

By the time a tentative conclusion is made and the committees start on examining methods of treatment it is too bloody late to do any good. But some highly paid nerds have managed to stay hermetically sealed from the problem, its bad effects, the people and planet's suffering and are backing the political party that is going to deal with the problem once and for all – with some disastrous machine thinking.

Let's cut out the middleman and work out alternatives ourselves, using practicality and skill and knowledge and commitment. Affluenza will have taken out 90% of those with the above, but just a small group with persistence may get through the barriers.
